M&M's is learning that it shouldn't mess with the "Naked Cowboy." He sued the candy maker, and late last month a judge decided to let the case proceed.
Robert Burck, 37, is a fixture of Times Square. He dresses in a pair of underpants, white boots and a Stetson hat and plays the guitar. M&M's has created an animated blue M&M with a very similar outfit.
Burck has sued Mars Inc., the company that makes M&M's. Burck claims that people might think he endorses the candy. District Court Judge Denny Chin feels that Burck has a point and will let the lawsuit proceed.

The blond-haired cowboy works out every day to maintain his muscular frame. He said he would never endorse the colorful candy.
"When they dressed up the M&M [like] the Naked Cowboy, they implied that I was endorsing their product," Burck told NBC television.
He mentioned type II diabetes and childhood obesity, which are both major health problems caused in part by junk food.
"I am the opposite of that. I don't endorse that product," he said.
