Cabinet approves labor amendment

The Cabinet yesterday approved a draft amendment of the Collective Agreement Law (團體協約法) so that employers of employees who are union members are prohibited from refusing to negotiate workplace disputes.
The amendment also provides for violators to be fined between NT$100,000 and NT$500,000 and will be submitted to the legislature for final approval.
"This law has not been changed for more than 70 years and needs to be fixed," said Vice Premier Chiou I-jen (邱義仁) during yesterday's Cabinet meeting.
"With this amendment, we are looking for a closer relationship between the employer and the employee. It is now possible for anything and everything to be discussed," he said.
Council of Labor Affairs Minister Lu Tien-ling (盧天麟) said it was international policy for laws to be established to protect employees' legal rights.
Taiwan has the Labor Union Law (工會法), the Settlement of Labor Disputes Law (勞資爭議處理法) and the Collective Agreement Law.
"Once the amendment of the Collective Agreement Law has been submitted to the legislature for final approval, we will seek to amend the Settlement of Labor Disputes Law," Lu said.
The amendment also stipulates that pay, working hours, bonuses, retirement benefits and injury compensation be stated clearly on job descriptions.
