Payments that women receive during maternity leave should reach at least the average monthly income of the new mothers during the six months prior to childbirth, Ministry of Labor officials announced on Monday, in a new legal interpretation of the Labor Standards Act (勞動基準法) that is to take effect immediately.
Previous regulations have based payments provided during maternity leave on the woman’s income during the single month leading up to childbirth.
Critics labeled that measure as being unfair to sales-based positions with fluctuating commissions, such as housing agents or insurance agents, as women who are pregnant might not excel at sales during their final month before delivery.
Ministry officials said the new regulation would allow new mothers to choose from the higher of two options during paid parental leave: the income during their last month of pregnancy, or the average of six months’ income before giving birth.
Ministry officials estimate that as many as 100,000 new mothers per year could benefit from the changed interpretation.
According to the Labor Standards Act, employees in the nation are entitled to eight weeks of paid maternity leave and two years of unpaid parental leave.
Employees can also apply for a maximum of six months of financial subsidies set to equal 60 percent of their monthly salary, which are funded by the nation’s Employment Insurance program, according to the regulation.
