The court action filed on Saturday by Republican presidential candidate George W. Bush, his vice presidential running mate Dick Cheney and seven Florida voters contends "irreparable injury" will be done if a hand count of votes in certain Florida counties proceeds.
The suit, comprising more than 90 pages of legal arguments and statements by voter plaintiffs, was filed in the US District Court for the Southern District of Florida. A hearing was set in federal court in Miami for 9:30am today. A "few score" of Republican lawyers are in Florida working on the election issue, according to Bush aides.
"If defendants' threatened manual recounts are allowed to proceed, plaintiffs will suffer irreparable injury," the Bush suit alleges.
"If an unlawful recount occurs, in violation of the First and Fourth Amendments [to the US Constitution], and a changed result happens to occur -- however unlikely -- that tainted result will be broadcast to the nation," it states.
"Any subsequent invalidation by this court will not be able to cure the serious damage to the legitimacy of the presidential election," the suit said. "Any such taint, and the perception of multiple reversals of outcome, will interfere with the orderly transition of constitutional government."
