Chinese students find New Oriental's argument perfectly reasonable. For the ETS, however, China has become a fast growing market. So it feels it has every reason to fight for its commercial interests through legal proceedings.
The US will certainly use more and more legal measures to protect its commercial interests once China enters the WTO. The legal grounds cited by the US, the cultural differences put forward by China and the principle of gradual compliance all seem to set the stage for the next wave of China-US trade. China will probably be much busier negotiating with the US after its entry into the WTO.
