DBTEL loses patent battle against US giant Motorola Inc

Motorola Inc, the world's second-largest cellular telephone maker, said a prosecutor in Taipei dismissed allegations the company infringed patents owned by DBTEL Inc (大霸電子).

DBTEL, a former Motorola subcontractor that now makes competing cellphones for companies such as Britain's BT Group Plc, claimed that Motorola Electronics Taiwan was incorporating DBTEL's copyrighted and patented designs in Motorola phones.

The prosecutor's office of the Taipei District Court dismissed the claims on June 6, ruling DBTEL hadn't proven its case.

The criminal complaint was part of battle that started when a manufacturing contract ended in April last year. Motorola claimed that DBTEL still owed US$48 million for handset components and was using Motorola's trade secrets to make cellphones for rivals. Motorola sued DBTEL in a US court to recover the money. The company also is asking Taiwanese authorities to invalidate DBTEL's design patent.
